Within our society, vulnerable people are increasingly at risk from the greed of their own families or acquaintances. This greed can lead to unauthorised transfers of money, or fraudulent or coercive transfers of property. How can the person, who may need their money to meet the costs of their needs and care, be compensated for what has happened? Who makes that decision? To what extent will the Police become involved? How easily will it be to establish undue influence and a breach of trust? If your primary witness lacks capacity to instruct a solicitor or give evidence, how can these cases succeed? And will it be cost effective?
Ian Cranefield of Richard Nelson LLP will be following a case study of financial recovery and examine the challenges and benefits of litigation.
