Hoarding Disorders and the Court of Protection

Speaker: Neil Allen, 39 Essex Chambers & University of Manchester

Some of the most difficult cases the CoP has to handle concern people with hoarding disorders – these are often cases in which evidence of incapacity is not clear and where there are finely balanced judgments as to the steps that the court should (or should not) take in P’s best interests.

The meeting will be preceded by our AGM, notice of which is attached. The AGM will be at 5pm immediately before the seminar.

Neil is a barrister at 39 Essex Chambers and a lecturer at Manchester University. Neil has particular interests in human rights, mental health and incapacity law, and has been involved in many of the leading cases in this field, including Cheshire West, N v ACCG, and Re X as well as many reported cases in the lower courts which have shaped the law. He recently appeared in Re AC and RC (Capacity: Hoarding: Best Interests) [2022] EWCOP 39 - the first reported case of its kind to consider capacity in the context of hoarding disorder
